Clear expectations. Better projects.
These Terms & Conditions explain how Bix Web projects, payments, revisions, hosting, ownership and related services are handled. They are designed to keep things clear for both of us before work begins.
Who are you working with?
Bix Web is the trading name used by Bianca for the provision of website design, website refresh, website hosting, domain, business email and related digital services.
Bix Web operates from Cape Town, South Africa.
By accepting a quotation, approving a project, paying a deposit or otherwise instructing Bix Web to begin work, the client acknowledges and accepts these Terms & Conditions together with the applicable quotation or written project agreement.
If a quotation contains terms that specifically differ from this page, the project-specific wording in the accepted quote will take priority for that project.
What Bix Web provides.
Services may include:
- New website design and development.
- Website redesigns and refresh projects.
- Responsive website implementation.
- WordPress and related website setup.
- Ecommerce website development.
- Website hosting.
- Business email setup.
- Domain registration or management assistance.
- Website migration.
- Content and website copy assistance where included.
- General website support and maintenance where agreed.
The services included in a specific project are those described in the accepted quotation or written agreement.
The quote defines the project.
Website prices displayed on bixweb.co.za are starting prices and are intended to provide a general indication of cost. The final project price will depend on the actual requirements.
A quotation will describe the agreed services, scope and price. Unless stated otherwise, quotations are valid for the period shown on the quotation.
Bix Web will not intentionally perform additional chargeable work outside the approved scope without first discussing the additional work and associated cost with the client.
How website projects are paid.
Required before project work begins unless otherwise agreed in writing.
Payable before final handover, transfer or website launch, unless the quote provides another arrangement.
Work will normally only be scheduled once the required deposit has been received.
Final website files, administrative access, transfers or other final deliverables may be withheld until all amounts due for the project have been paid in full.
Hosting, domain renewals and other recurring services are generally payable in advance for the applicable renewal period.
What is included — and what isn't.
The accepted quotation defines the project scope.
Requests that materially extend the agreed project may be treated as additional work.
Examples may include:
- Additional pages beyond the quoted page count.
- New functionality not included in the original brief.
- Booking, membership or custom portal functionality.
- Additional ecommerce products or extensive product loading.
- Custom integrations.
- Extensive content writing not included in the quotation.
- Logo or brand design not included in the original scope.
- Major structural changes after approval.
Additional work will be discussed and, where appropriate, separately quoted before proceeding.
Two reasonable revision rounds.
Unless a quotation states otherwise, Bix Web includes two reasonable revision rounds as part of the website design project.
A revision round is intended for reasonable changes to the proposed design, layout, copy or content based on the agreed project direction.
A revision round does not include a complete redesign, significant change of business direction, substantial change to the approved brief or rebuilding previously approved work.
Further revisions or major changes may be quoted separately.
What Bix needs from you.
The client is responsible for providing the information and materials reasonably required to complete the project.
This may include:
- Business information.
- Approved logos and branding.
- Images or photographs.
- Website copy and product information.
- Pricing and service information.
- Domain or hosting credentials where required.
- Access to existing systems where reasonably necessary.
- Timely feedback and approvals.
The client is responsible for checking the factual accuracy of business information, pricing, contact details, legal information and other content before launch.
Timelines depend on both sides.
Any estimated project timeline assumes that required content, access, approvals and feedback are provided reasonably promptly.
Delays in receiving client content, approvals, login details, decisions or feedback may extend the project timeline.
A project that remains inactive because required client input has not been received for 30 days may be paused and rescheduled according to Bix Web's availability.
Where a project is later resumed, revised timelines will be agreed based on current workload and project requirements.
Please check before approving.
The client may be asked to approve designs, content, layouts, products or other elements during the project.
Once an item has been approved, substantial later changes may fall outside the included revision allowance.
Before launch, the client should review the completed website and notify Bix Web of any reasonable corrections that fall within the agreed scope.
If a project is cancelled.
A client may request cancellation of a project in writing.
Where a project is cancelled after work has started, Bix Web may retain or charge a reasonable amount for work already completed, time committed, third-party costs incurred and other reasonable losses directly associated with the cancellation, subject to applicable consumer law.
Any refund due will be assessed according to the stage of the project, the work completed and costs already incurred.
Where Bix Web has not yet begun meaningful work and has not incurred material costs, any applicable refund will be handled reasonably in the circumstances.
What becomes yours.
Once all project fees have been paid in full, the client will receive the rights to the final website work created specifically for that client, subject to any third-party licences, restrictions and platform terms.
This does not transfer ownership of:
- WordPress or other third-party platforms.
- Third-party themes and plugins.
- Licensed fonts, images or stock assets.
- Reusable code libraries.
- General design systems or methods.
- Tools or templates developed independently of the client project.
- Third-party software or services.
No ownership transfer takes place until the project has been paid in full.
Please only send content you may use.
The client confirms that they have the necessary rights, licences or permission to use any logos, images, photographs, videos, text, trademarks, documents or other materials supplied to Bix Web.
Bix Web is entitled to rely on the client's confirmation that supplied material may lawfully be used.
The client remains responsible for claims arising from material supplied by the client without the appropriate rights or permissions.
Websites rely on other services too.
Websites may rely on third-party software, plugins, themes, payment gateways, APIs, hosting providers, domain registries, email services or other technology providers.
Those services may be subject to their own licence terms, pricing, availability and privacy policies.
Bix Web cannot guarantee that a third-party provider will never change, discontinue or alter its product, pricing or features.
Where an external service later requires a paid licence, subscription or upgrade, the client will be advised where reasonably possible.
Hosting through Bix.
Where hosting is purchased through Bix Web, the hosting period and applicable annual fee will be confirmed at the time of purchase or renewal.
Bix Web's current standard annual hosting package may include website hosting, security, backups and up to five business email accounts where applicable to the selected package.
Hosting fees are payable in advance.
Hosting and internet services depend on infrastructure and third-party providers. Bix Web therefore does not guarantee uninterrupted or 100% uptime.
Bix Web will take reasonable steps to assist with hosting issues within its control.
Hosting may be suspended for overdue accounts after reasonable notice.
Renewal pricing may change in future due to infrastructure, licensing, exchange-rate or supplier cost changes. Where practical, clients will be informed before renewal.
Your domain remains your business asset.
Domain registrations are subject to availability and the rules of the applicable domain registry or registrar.
Where Bix Web registers or manages a domain on behalf of a client, the intention is that the domain remains an asset of the client, subject to payment of applicable registration and renewal fees.
Clients are responsible for ensuring domain and email services are renewed when payment becomes due.
Business email services may be subject to storage limits, acceptable-use rules and technical restrictions imposed by the relevant provider.
A good website helps. Rankings aren't guaranteed.
Bix Web may apply reasonable website structure, usability, technical and on-page SEO practices where relevant to the project.
Unless specifically contracted as an ongoing SEO service, website design does not include a guarantee of search-engine rankings, specific Google positions, traffic levels, leads, enquiries or sales.
Search rankings and website performance can be influenced by many factors outside Bix Web's control, including competition, search-engine algorithms, content, reputation, marketing activity and third-party platforms.
What happens after launch?
Bix Web will correct reasonable technical issues attributable to the delivered website where those issues relate directly to the agreed project work and are reported within a reasonable period after launch.
Ongoing content changes, new functionality, redesigns, maintenance or support outside the original project may be separately quoted.
Problems caused by third-party changes, client modifications, external hosting changes, malware introduced after handover or unsupported software may fall outside the original project scope.
Showing the work.
Unless otherwise agreed in writing before the project begins, Bix Web may display the completed website, the client's business name and publicly available screenshots of the work in the Bix Web portfolio, website, proposals and social media for the purpose of showcasing completed work.
Clients requiring confidentiality should raise this before commencement of the project so that an alternative arrangement can be agreed.
Reasonable limits.
Bix Web will perform services with reasonable care and skill.
To the extent permitted by law, Bix Web will not be responsible for indirect or consequential losses arising from matters such as lost profits, lost sales, third-party outages, search-ranking changes, security incidents outside reasonable control, third-party software failure or incorrect information supplied by the client.
Nothing in these terms is intended to exclude or limit rights that cannot lawfully be excluded under applicable South African consumer protection legislation.
Keeping disagreements practical.
These Terms & Conditions are governed by the laws of the Republic of South Africa.
If a disagreement arises, both parties should first attempt to resolve the matter reasonably and in good faith through direct discussion.
Nothing in these terms prevents either party from exercising any right or remedy available under applicable South African law.
Questions about the terms?
If you need clarification before accepting a quote or beginning a project, please contact Bix Web.
Clear from the beginning. Easy from there.
If anything in these terms isn't clear, ask before accepting your quote. I'd rather make sure we're on the same page from day one.
